Terms of Service

tn-proto.org and the TN Cloud Vault (the “Service”) are operated by Cyaxios. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
TN is a developer protocol for attested logging and broadcast encryption. The Service consists of the open-source SDK, the hosted vault at vault.tn-proto.org, related dashboards, documentation, and any integrations published under the tn-proto.org domain. The Service is provided as a convenience. It is intended for authorized development, testing, and operational use of the TN protocol; it is not intended as a system of record, an authoritative archival service, or a regulated data store.
2. Eligibility and Accounts
You must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater. You must provide accurate information when registering. You are responsible for the security of your credentials, your devices, and any activity that occurs under your account. We may refuse, suspend, or terminate any account at our discretion.
3. Encryption and Key Handling
TN’s design centers on the principle that the vault never holds your keys in plaintext. Specifically:
- Your master keys are generated locally on your device by the SDK. The private half never leaves your device in plaintext.
- The SDK encrypts your keystore with a passphrase or device-bound key before any upload. The vault receives ciphertext only.
- Limited initial-upload exception: in some onboarding flows the SDK uploads an initial encrypted bundle whose body-encryption key travels in a URL fragment to the claiming browser. During the brief window between upload and claim, the encrypted bundle exists on our infrastructure. The bundle remains encrypted; we do not retain or process the body-encryption key. Once claimed (or after the unclaimed-bundle expiry), the bundle is removed.
- Your log entries and plaintext fields are never sent to the vault by design. The vault stores only attested ciphertext, signing metadata, and administrative records.
Encryption is not a guarantee of secrecy. It is a contractual and technical commitment that we will not, in the ordinary course, possess the means to read your encrypted material. It does not protect against compromise of your own device, loss or disclosure of your passphrase or keys, vulnerabilities in third-party software you choose to use with the Service, or future advances in cryptography.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation;
- Infringe any intellectual property right or other right of any party;
- Transmit any malicious code, conduct any attack against the Service or its users, or attempt to defeat any rate limit, access control, or security measure;
- Reverse-engineer the Service except to the extent expressly permitted by applicable law;
- Use the Service to send unsolicited communications, harass any person, or facilitate any illegal activity;
- Misrepresent your identity, your relationship to any third party, or the provenance of any record submitted to the Service.
5. Your Content
You retain all rights in the encrypted material and metadata you submit to the Service. You grant Cyaxios a limited, non-exclusive, royalty-free license to host, transmit, and back up your encrypted material solely for the purpose of operating the Service. We do not claim any rights in the plaintext content of your records, which we do not possess.
6. Retention and Deletion
The Service applies inactivity-based retention to backed-up material:
- Free tier: after six months of no account activity, we send a 14-day notice to your registered email. If we receive no further activity, we soft-delete your encrypted backups. After 30 additional days of continued inactivity, we permanently and irrecoverably delete them.
- Paid tiers: the same process applies on a two-year inactivity threshold.
- Unclaimed initial uploads: the brief-window encrypted bundle described in Section 3 is purged 24 hours after upload if not claimed.
- Account deletion on request: you may delete your account at any time. We honor deletion requests within a reasonable time and remove your encrypted material on the same hard-delete cadence as the inactivity sweep.
Any activity from a registered device, dashboard sign-in, or SDK call against the vault resets the inactivity clock.
7. No Warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT ANY DATA STORED OR TRANSMITTED THROUGH THE SERVICE WILL BE PRESERVED, RECOVERABLE, OR FREE FROM CORRUPTION OR LOSS.
The Service is a convenience. We do not promise availability, uptime, or continuity. We do not promise that your encrypted backups will remain available, retrievable, or restorable for any specific period or at all. You are responsible for maintaining your own copies of any material you cannot afford to lose.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CYAXIOS, ITS OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF DATA, LOSS OF KEYS, LOSS OF PROFITS, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER LOSS, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS.
9. Indemnification
You will indemnify, defend, and hold harmless Cyaxios and its affiliates, officers, employees, contractors, and agents from and against any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any material you submit to or transmit through the Service.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, for any reason or no reason, including for actual or suspected violations of these Terms or for the protection of the Service or its users. Sections 5 through 13 survive any termination.
11. Changes
We may modify these Terms from time to time. The Effective Date at the top of this page reflects the most recent change. Material changes will be notified by a banner in the Service or by email to your registered address. Your continued use of the Service after a change takes effect constitutes acceptance of the modified Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in English in Wilmington, Delaware (or remotely if both parties agree). YOU AND CYAXIOS EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The foregoing does not prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights or confidential information.
13. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of the right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and Cyaxios regarding the Service. You may not assign these Terms; we may assign them in connection with a corporate transaction or to an affiliate.
